1. Agreement to Terms

By accessing or using the services provided by Schlickmann Construction ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Services Description

Schlickmann Construction provides professional holiday lighting installation, maintenance, and removal services for residential and commercial properties in Massachusetts. Our services include:

• Custom holiday lighting design and consultation
• Professional installation of Christmas lights and decorations
• Maintenance and repair during the holiday season
• Post-season removal and storage options
• Commercial and municipal lighting services

3. Service Agreement

3.1 Quotes and Estimates

All quotes provided are estimates based on information provided by the customer. Final pricing may vary based on actual site conditions, additional requests, or unforeseen circumstances discovered during installation.

3.2 Scheduling

Installation dates are scheduled based on availability and weather conditions. We reserve the right to reschedule installations due to inclement weather or other safety concerns without penalty.

3.3 Property Access

By engaging our services, you grant our team access to your property for the purpose of installation, maintenance, and removal of holiday lighting. You are responsible for ensuring safe access to all areas where work will be performed.

4. Payment Terms

• A deposit may be required to secure your installation date
• Balance is due upon completion of installation
• We accept major credit cards, checks, and electronic payments
• Late payments may incur additional fees
• Returned checks will be subject to a $35 fee

5. Cancellation Policy

• Cancellations made 14+ days before scheduled installation: Full refund of deposit
• Cancellations made 7-13 days before: 50% of deposit refunded
• Cancellations made less than 7 days before: Deposit is non-refundable
• No refunds for services already rendered

6. Warranty and Liability

6.1 Workmanship Warranty

We warrant our installation workmanship for the duration of the holiday season. If lights malfunction due to our installation, we will repair or replace them at no additional cost.

6.2 Equipment

When using customer-owned equipment, we are not responsible for pre-existing damage or equipment failure due to age or wear.

6.3 Limitation of Liability

Schlickmann Construction's liability is limited to the cost of services provided. We are not liable for indirect, incidental, or consequential damages arising from our services.

7. Property and Safety

• We take reasonable care to protect your property during installation and removal
• Minor cosmetic issues (small marks, clips) may occur during normal installation
• Please inform us of any fragile surfaces, loose shingles, or areas of concern
• We carry general liability insurance for your protection

8. Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of Schlickmann Construction and is protected by copyright laws. You may not reproduce, distribute, or use our content without written permission.

9. Customer Responsibilities

As a customer, you agree to:

• Provide accurate property information for quotes
• Ensure electrical outlets are functional and accessible
• Notify us of any changes to your property or requirements
• Keep the work area reasonably clear and accessible
• Inform us of any HOA or community restrictions

10. Force Majeure

We are not liable for delays or failure to perform due to circumstances beyond our control, including but not limited to natural disasters, severe weather, power outages, pandemics, or government restrictions.

11. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If resolution cannot be reached, disputes will be subject to binding arbitration in the State of Massachusetts.

12. Governing Law

These Terms are governed by the laws of the State of Massachusetts, without regard to conflict of law principles.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified Terms.
